Respect for Intellectual Property

Foremy respects the intellectual property rights of others and expects users of our Site to do the same. This policy explains how to submit a copyright infringement notice under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and how we handle such notices.

Filing a DMCA Takedown Notice

If you believe that content on foremy.com/ infringes your copyright, please send a written notice to our designated agent containing the following information, as required by 17 U.S.C. ยง 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material claimed to be infringing, including the specific URL(s) on our Site, with sufficient detail to allow us to locate it;
  4. Your contact information, including address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices should be sent to: admin@foremy.com with the subject line “DMCA Notice.”

Counter-Notification

If you believe material you posted was removed in error, you may submit a counter-notice containing:

  1. Your physical or electronic signature;
  2. Identification of the material removed and its location before removal;
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the complaining party.

Upon receiving a valid counter-notice, we may restore the material within 10–14 business days unless the original complainant files a court action seeking a restraining order.

Repeat Infringer Policy

Foremy will, in appropriate circumstances, remove content and/or terminate the accounts or access of users who are found to be repeat infringers.

False Claims

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.
